Ethical Issues and Disqualification of Expert Witness. See Chapter 41 of the book for further reading

At its simplest, ethics is a system of moral rectitude and principles that seeks to resolve questions of human morality by defining concepts such as good and evil, right and wrong, virtue and vice, justice and crime. As a term, it is derived from the Greek word ethos which means custom, habit, character or disposition. Our commitment to act with integrity and honesty in accordance with widely recognised moral principles underlies the very foundation of ethical conduct, be it in our profession or in whatever calling we find ourselves. In consequence, conduct becomes unethical when it falls below or violates the professional standards expected in an expertise.

Ethical issues arise whenever expert witnesses are involved in a trial. The most frequently litigated issues, related to expert testimony, involve its admissibility. The integrity of the judicial process depends (on matters of expert opinion) to a great degree on the truthfulness, objectivity, and avoidance of undue bias in the expert testimony.

The Focus of this Weekly Module

Ethical consideration, dealing with expert witness, can arise at any stage in a case. In that regard, this weekly module examines these issues, addressing key different areas where ethical issues may arise such as conflict of interest; cognitive bias and engagement of an expert as both adviser and independent expert.
