The ever-increasing volume of ESI has made responding to electronic discovery requests an expensive endeavour for large and small companies alike. Along with time (and the corresponding delay), it is the cost of discovery that underscores the need for proportionality. The principle of proportionality as a popular eDiscovery concept is all about discovery in litigation being proportional to the case in which it is issued. In discovery, it is usually court’s obligation to limit the frequency or extent of discovery if the burden or expense of the proposed discovery outweighs its likely benefit, considering the needs of the case, the amount in controversy, the parties’ resources, the importance of the issues at stake in the action, and the importance of the discovery in resolving the issues. Weighing the monetary cost of eDiscovery against the value and importance of the information sought is an obvious first consideration in any eDiscovery proportionality analysis.

The aim of this weekly module reviews the burden and cost associated with the preservation of potentially relevant information in eDiscovery, by exploring the concept of proportionality, eDocument search methodology, and the application of metadata in the production process.
