It is trite that in civil proceedings, the writ and the statement of claim, in certain circumstances, constitute the first step in getting to trial. These documents, in compliance with relevant rules, once filed in the appropriate court, formally establish a cause of action against the other party. The answer to the writ and the claim is the defendant’s official admission/denial of the facts and issues asserted in the claimant’s complaint, including any affirmative defences that the defendant asserts. The court, in accordance with its civil procedure rules, issues a case management order for the pre-trial conference soon after the complaint and answers are filed.

The Focus of this Weekly Module

It is believed, that in accordance with the issues raised and addressed in Chapters 19 to 23 of the book, the counsel is appraised of the early requirements that usher in discovery process in the digital domain, and consequently have enough information that would enable him proceed to trial, where expedient. Our focus herein is to guide the Counsel or the court on the steps to be taken during the pre-trial conference to determine what electronic documents exist and what computer systems and or expert resources that may be necessary in order to obtain the documents so required.
