The process of discovery presents an enormous set of challenges for organisations and counsel today. It is costly, disruptive and unpredictable. As information growth soars, stricter requirements for management and control reinforces the critical need to properly interpret growing volumes of complex data and develop an effective discovery response plan. Litigation readiness involves the strategic development of best practices and operating procedures to facilitate the control of an organisation’s electronically stored data (ESI) and potential evidence. Effective litigation readiness improves response time, reduces disruptions to business and the impact that eDisclosure has on the final costs of litigation, thereby improving the overall discovery process and lowering the risk of evidence tampering.

The Focus of this Weekly Module

Although electronic discovery for most counsel, still remain alien and a formidable territory, technological competence is now acknowledged as a prerequisite for modern law practice. This requires the legal knowledge, digital skill, thoroughness and preparation reasonably necessary for that representation. Counsel must therefore stay abreast of the changes in the law and its practice and understand the benefits and risks associated with relevant technology. Because they cannot abdicate their responsibility due to ignorance of the current technology as they impact on the modern law practice, our aim in this weekly module is to guide them, despite the odds, to have a firm understanding of their clients’ information architecture; avoid missing relevant documents during collection and ensuring proper preservation throughout the litigation life cycle.
