It is an established fact that electronic communication has become the predominant and preferred form of communication in all aspects of business and social relations. As records and files in today’s dispensation are born digital, observers or witnesses on the scene of any incident can now document the details of events with photographs, video and audio recordings from their digital devices such as cell phones and cameras. Postings of real-time commentary (often transmitted through mobile devices) on websites such as YouTube and global social media sites, previously unavailable real-time, have now become common place. Therefore, in court proceedings, traditional eyewitness testimony can be greatly enhanced and corroborated by introducing evidence derived from these devices. These challenges become more compelling that, in today’s litigation, a trial lawyer is often inundated with vast amounts of computer data, computer models, audio and video files, medical imagery, CAD designs, computer-generated charts, animations, emails, spread-sheets, digital recordings, website materials, instant messages, digital photographs, chat room transcripts, metadata, etc.

The Focus of this Weekly Module

Because it is an undeniable fact that the proliferation of these devices that result in the creation and transmission of huge amounts of digital information has created unprecedented challenges in legal proceedings, the focus of this weekly discourse is on how the courts would decide on proper authentication of digital information under the current judicial rules and procedures.
