The complexities of modern business information systems and global communications technology make it imperative for litigators to demonstrate that the digital evidence is what the proponent claims it to be. Therefore, there must be a foundation that takes into account not only the legal requirements of procedure and evidence, but also an evaluation of each of the key components of the information system from which the evidence was created, processed, stored, generated and transmitted.

The Focus of this Weekly Module

This lecture focuses on these components as the building block of the evidentiary requirement in litigation that encompasses digital evidence and eDiscovery as espoused in Section 84 of the Evidence Act, 2011 on the admissibility of digital evidence.
